All matters concerning family relations are resolved by Family Courts, which have such jurisdiction, in accordance with Article 111 (as amended by Law 95/89) of the Constitution of the Republic of Cyprus.
The Family Courts in Cyprus, due to the large number of cases they handle over the years, have created their own jurisprudence as a result of which they have created legal principles applicable to Cyprus family matters and it can be argued that an autonomous Cypriot family law has been created under consistency. Family Courts deal with cases involving divorce, separation of cohabitation and use of family home, relations between parents and children and relations between spouses.
Divorce by consent is now also allowed in Cyprus following an amendment made to the legislation (Law 104(I)/2003) in 2023. The mutual consent dissolution of marriage which causes an irreconcilable shock to the relations between the two spouses is now considered a reason for divorce. At least 6 months must have passed since the marriage took place, and if there are children, then the spouses must have either settled the issues of custody and communication or registered an application for the issuance of a consent decree regarding the children.
